I have more than 25 years of experience in construction and engineering as both a litigator and a transactional lawyer and provide my clients with advice spanning both contentious and non-contentious matters relating to construction, engineering and infrastructure projects. 

As a litigator, I have experience in adjudication, arbitration and alternative dispute resolution and have acted as an adjudicator in numerous construction and engineering disputes. On the non-contentious side, I draft and negotiate all forms of construction and engineering contracts and advise on bonds and guarantees related to those contracts. I have also advised on engineering contracts for oil and gas companies and pharmaceutical infrastructure projects.

Prior to qualifying as a solicitor, I practiced as an architect where I was involved in hotel, office and retail projects. This background provides me with unique insight into the problems associated with construction projects.  

Experience highlights

  • Acting for an international five-star hotel chain on disputes and negotiating their construction contracts and appointments
  • Acted for a private individual in respect of a £5m claim against the professional team on her build project where the property was not habitable. Secured a settlement out of court for the client.

  • On behalf of a multinational company specialising in luxury goods, reviewed and advised on the contract for the design, fabrication and installation of pop-up exhibition space and advising on the contracts for the design and construction new boutiques in the UK.

Anne Wright

I am a specialist Construction and Engineering lawyer providing project advice on construction and planning law aspects of commercial real estate and infrastructure funding and development.

After qualifying in 1982 and having worked at a number of Magic Circle firms, I joined Lawrence Stephens in December 2006 to establish the firm’s Construction department. My experience spans residential and commercial developments, construction, infrastructure and health projects, PFI and Public Private Partnership projects. I also advise extensively from procurement and tendering, through to the negotiation and settlement of the project documentation.

Notwithstanding many work commitments, I give presentations, lectures and broadcasts on topical areas of law and practice. I am an occasional lecturer at King’s College London’s Construction and Arbitration MSc course and also act as dissertation tutor. I have published a number of articles on Project Finance and PFI law and and have a chapter in the King’s College London and LCIA’s book.

I am married and live in London and Somerset. I enjoy horse racing, skiing and the opera.

Tom Pemberton

I advise on all stages of procurement and the execution of a wide variety of building, engineering and infrastructure projects in the UK and abroad, including projects of national importance.

I offer expertise in drafting and negotiating development agreements, construction contracts, professional appointments and related agreements, building on my experience over many years of advising on high profile construction and infrastructure projects and my knowledge of the domestic and international real estate and infrastructure sectors.

My clients are building owners, developers, funders, contractors and consultants.  I recognise the importance of providing “value added” services at no charge, including regular meetings to obtain feedback on work carried out and to provide updates on legal developments.

I have a longstanding relationship with the Civil Engineering Contractors Association, the representative body for companies who work day-to-day to deliver, upgrade and maintain the country’s infrastructure.  I drafted the CECA Generic Form of Sub-Contract which was published in September 2020 for use in conjunction with a wide range of standard form and bespoke main contracts.  I sit on the CIC Liability Panel, which considers legal issues of interest to construction professionals and others in the industry.

I am also a well-known speaker on a wide range of topics, including construction contract forms, alliancing/collaborative contracting, case-law on issues such as contractors’ and consultants’ design liability, the Construction Act (as amended in 2011), and other topics of interest to the construction and engineering industry.  I regularly contribute articles on construction law issues to specialist journals.

I am married with two children and live in Surrey.  I am a long suffering supporter of Charlton Athletic and enjoy cycling, running and playing racquet sports.

Experience highlights 

  • Advising in the drafting and negotiating of a number of contracts for key works packages in the construction of Hinkley Point C nuclear power station, including the groundworks package and the supply and the installation of an electrical supply back up system; the criticality of these contracts required an in depth analysis of the key risks and the most appropriate ways to manage and mitigate them
  • Advising on procurement methodology and preparing and negotiating the contracts for the design and construction of various housing, office and commercial projects in the UK, including new builds, refurbishments and fit outs.  An important element of this work is ensuring the appropriate allocation of risks such as those arising from the global constraints on the supply of labour and materials following Brexit and the pandemic
  • Drafting and negotiating the contracts relating to a number of construction and engineering projects internationally, including in the USA and the Middle East; liaising with local lawyers as necessary to ensure compliance with local law
  • Acting for a number of banks in the financing of various developments.  Among others, this has involved advising on the development security aspects of an additional financing package in relation to a large housing development where the project costs exceeded the budget, in order to ensure the successful completion of the project and repayment of the loan
  • Providing project advisory services including the management of claims and strategies to settle disputes or where this has not been possible arranging for the issue and conduct of dispute proceedings
