This expertise is complemented by our Recoveries team. This is not a side offering of real estate disputes or debt recovery teams, but a dedicated secured recoveries capability. Our understanding and expertise within this market means that we are well placed to resolve any problems should a borrower default.
We help secured creditors (typically a bank or lender) to recover debt from a borrower who has failed to meet the terms and conditions of the loan agreement.
Our services include:
- Identifying default events and advising on exercising rights under security documents
- Enforcing a share charge
- Taking possession of the property held as security
- Applying for and obtaining orders for sale
- Appointing a fixed charge receiver
- Appointing an administrator pursuant to the terms of a debenture
- Pursuing any guarantor(s)
- Handling the sale of secured assets
- Bankruptcy or winding-up petitions (if the borrower is insolvent).
